The only news concerning Social Security is the revelation the senate bill S. 2611 will allow illegals the opportunity to receive the Social Security their employers deducted during their employment.  If the Social Security office can not match the illegals name with a bona fide Social Security number their contribution is held in a special fund. 

 

THE IDENTIY THEFT AND ASSUMPTION DETERRENCE ACT

 

“In October 1998, Congress passed the Identity Theft Act to address the problem of stealing some ones identity. Specifically, the Act amended 18 U.S.C. &1028 to make it a federal crime when anyone:

 

knowingly transfers or uses, without lawful authority, a means of identification of another person with the intent to commit, or to aide or abet, any unlawful activity that constitutes a violation of Federal law, or that constitutes a felony under any applicable State of local law.

 

Violations of the Act are investigated by federal investigative agencies  such as the U.S. Secret Service, the FBI, and the U.S. Postal Inspection Service and prosecuted by the Department of Justice.”

One day I decided to contact the FBI keeping in mind our taxes pays their salaries and they should be working for us.  I talked with a Mr. Logan….the bottom line nothing is done to illegals when they are apprenhed and are using a stolen or false Social Security number unless they commit serious crimes.  I asked several questions but the answer was the same.  What I REALLY WANTED TO ASK ISN’T STEALING A SOCIAL SECURITY NUMBER A SERIOUS CRIME?  Maybe I will call again!!

 

In a June 17, 2006 article Audra Schmierer (Dublin CA) had her Social Security number stolen and used by 81 people in 17 states.  “The federal government took years to discover the number was being used illegally, but authorities took little action then.  She realized she had a problem when she received a statement from the IRS in February 2005 saying she owed $15,813 in back taxes even though she had not worked since 2002.  She has obtained more than 200 W-2 and 1099 tax forms that contain her SS number but different names from throughout the country”.  Investigators found one man who had used her information in 2003 in Texas.  According to another police report a man told them he bought a fake Social Security card at a flea market.  He was NOT arrested!!!  If I try using a fake SS and get arrested will you all send money for an attorney?  Illegals also pay for fake drivers licenses.  Can’t read English but they drive our highways.

“Last year, both the President and many Members of Congress said Social Security was in such dire financial condition that benefits would have to be cut to make the program solvent.  Nevertheless, Congress now may allow access to Social Security for potentially millions of new people under "guest worker" immigration reform legislation, and a related U.S. Social Security totalization agreement with Mexico.  Under both, immigrants who worked here for some time illegally would gain access to work-authorized Social Security numbers.  According to Social Security’s Inspector General, whose job it is to protect the program from fraud and abuse, once an immigrant has a work-authorized number, all work credits, whether earned legally or illegally, could be applied to their Social Security account. If so, immigrants and all their entitled dependents would become eligible for benefits sooner and potentially draw higher benefits, based on earnings while illegal. “

“The effect on Social Security would be severe, because the program pays more than just retirement benefits.  It also pays a maximum family benefit, and many immigrants tend to have large families.  A spouse, divorced spouse, children, even dependent parents who meet eligibility requirements may receive benefits based on a worker’s account.  For example, a worker who retires in 2006 with an initial monthly benefit of $1,700 would have a total maximum family benefit of $2,917.46.  Thus, a retiree and eligible family members could receive a monthly maximum of up to $2,917.46.”

“Regardless of whether Congress moves on "guest worker" immigration legislation, the President may still send the U.S.-Mexico Totalization Agreement to Congress.  The U.S. currently has 21 totalization agreements with other nations.  They allow workers who split their careers between the U.S. and another country to combine (totalize) work credits earned in both countries in order to meet the minimum benefit qualification requirements.”

“Unlike legislation, totalization agreements are treaties negotiated by two nations and don’t require Congressional approval to take effect.  Congress can however, stop a totalization agreement from taking effect by disapproving the agreement.  Once Congress receives the agreement from the President, lawmakers will have just 60 legislative days in which to disapprove the agreement.”

COST   OF LIVING: $3.87 FOR ME---$ 3,300  FOR  CONGRESS  NO INCREASE IN THE $5.15 MINIMUM WAGE

 

As required by the Government Pension Offset law I walked into the Social Security office on July fifth and watched as 2/3s of $3.87 was subtract from my Social Security benefits.     Before the transaction was completed I HAD TO WAIT 1 AND ½ HOURS . It gave me a feeling of helping Congress spend my money towards the more than $1 billion every year to encourage democracy in other countries.  Just a few  examples

Can we save our citizens, save Social Security?  Yes by eliminating waste, fraud and collecting the billions owed the government.  A March 19, 2006 headline…….

 

BILLIONS UNCOLLECTED IN FEDERALLY ORDERED PENALTIES

The government is currently owed more than $35 billion in fines and other payments from criminals and in civil cases, according to Justice Department figures.. 

 

Very often my dear son, Neal says stay on the subject the GPO/WEP.  I hope you all can understand these headlines point out that  Congress IS NOT DOING ITS JOB.  They need to stop spending our SS surplus, stop sending our taxes to other countries, use their authority to collect penalties, stop funding “bridges that go nowhere”  stop earmark pork.  Then they can repeal the GPOWEP and return the taxes we paid into the SS fund.  The subject of illegals definitely affects the American life style and our Social Security funds.

A BILL

To amend title II of the Social Security Act to exclude from creditable wages and self-employment income wages earned for services by aliens illegally performed in the United States and self-employment income derived from a trade or business illegally conducted in the United States.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the `No Social Security for Illegal Immigrants Act of 2005'.

SEC. 2. EXCLUSION OF UNAUTHORIZED EMPLOYMENT FROM EMPLOYMENT UPON WHICH CREDITABLE WAGES MAY BE BASED.

Section 210(a)(19) of the Social Security Act (42 U.S.C. 410(a)(19)) is amended--

(1) by striking `(19) Service' and inserting the following:

`(19)(A) Service performed by an alien while employed in the United States for any period during which the alien is not authorized to be so employed.

`(B) Service'.

SEC. 3. EXCLUSION OF UNAUTHORIZED FUNCTIONS AND SERVICES FROM TRADE OR BUSINESS FROM WHICH CREDITABLE SELF-EMPLOYMENT INCOME MAY BE DERIVED.

Section 211(c) of the Social Security Act (42 U.S.C. 411(c)) is amended by inserting after paragraph (6) the following new paragraph:

`(7) The performance of a function or service in the United States by an alien during any period for which the alien is not authorized to perform such function or service in the United States.'.

SEC. 4. EFFECTIVE DATE.

The amendments made by this Act shall apply with respect to wages earned, and self-employment income derived, before, on, or after the date of the enactment of this Act. Notwithstanding section 215(f)(1) of the Social Security Act (42 U.S.C. 415(f)(1)), as soon as practicable after the date of the enactment of this Act, the Commissioner of Social Security shall recompute all primary insurance amounts to the extent necessary to carry out such amendments. Such amendments shall affect benefits only for months after the date of the enactment of this Act 

 

 

PLEASE  PLEASE  IT IS VITAL YOU CALL AND WRITE YOUR SENATORS AND REPRESENTATIVES ASKING THEY COSPONSOR THIS BILL.  ASK THAT YOU RECEIVE A CONFIRMATION OF THE DATE HE/SHE SIGNED.

 

If you recall in a recent newsletter I said NARFE begged people when the GPO and WEP were being debated to contact Congress and ask these unfair bills not be made law.  Because very few responded WE ARE PAYING THE PRICE TODAY.  Please share this newsletter with your family, relatives, co-workers, and friends. The affect of the recently passed senate bill and the fact illegals will have access to our Social Security can cut into EVERYONE’S  children’s  and grandchildren’s Social Security. 

 

Recently we celebrated the Fourth of July and I heard many politicians quoting  the Declaration of Independence.  I wondered if they truly understood those words. I quote part of the declaration.

 

                       “ In Congress, July 4,1776

The unanimous Declaration of the thirteen united States of American”

 

“We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness—That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed,---That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness.”

 

Therefore do we not have the right to receive the promised return of the funds we and or our husbands contributed to Social Security?  The Government Pension Offset and the Windfall Elimination Provision denies our ability to achieve our “inalienable Rights….Life, Liberty, and the pursuit of Happiness”  Quote the constitution to your representatives….”Governments are instituted among Men, deriving their just powers from the consent of the governed”  What could be more clearer that denying teachers, police , firefighters their earned Social Security IS DENYING OUR U.S. CONSTITUTION!!

 

Everyone will be home soon asking for your vote.  I strongly suggest you try to attend any meetings the politicians hold in your area. IF they are in the senate ask them to justify passing a bill that allows illegals to receive SS and they continue to deny passing Sen. Feinstein’s repeal bill S. 619? NO SS for YOU.
